Code Section 18.2-60.3 – Stalking

A. Any person, except a law-enforcement officer, as defined in §9.1-101, and acting in the performance of his official duties, and a registered private investigator, as defined in §9.1-138, who is regulated in accordance with §9.1-139 and acting in the course of his legitimate business, who on more than one occasion engages in conduct directed at another person with the intent to place, or when he knows or reasonably should know that the conduct places that other person in reasonable fear of death, criminal sexual assault, or bodily injury to that other person or to that other person's family or household member is guilty of a Class 1 misdemeanor.

In a stalking situation, it is very important to stay safe.  Here are some options:

  • Completely terminate the relationship by having you or your attorney send a certified letter stating the behavior must stop immediately.

  • Let everyone know you are being stalked.

  • Document in a stalking log what is occurring…take notes of dates, times, and locations of where you see the stalker, what they were wearing, saying, and take a photo if possible of the stalker or the vehicle they are in.

  • Notify law enforcement if there has been more than one occasion that the stalker has caused you to fear death, sexual assault, or bodily injury.  Press charges if possible.

  • Save anything the stalker has given you…written material, texts, cards, flowers, etc.

  • Obtain a PO Box.

  • Post No Trespass signs on your property.

  • Join a support group/develop a support system.

  • Obtain a Protective Order.

  • Be aware of your surroundings in parking lots, park under a light source and walk to/from your vehicle with others.

  • Do not accept any packages unless you know you are expecting them.

  • Change your routes to/from work and/or running errands.

  • Screen calls, e-mails, and packages…and if the stalker shows up at your work (give secretary/security guard a recent photo of the stalker), notify 911 immediately.
