The Code of Virginia § 58.1-3965 authorizes the Treasurer to initiate the sale of real estate which is delinquent for more than 2 years as of December 31st. The Treasurer reviews properties with delinquent taxes periodically to determine which properties will be sold. After owners are notified, a legal notice is published in the local newspaper as well as on this site.
If the taxes aren't paid or a payment arrangement reached with the Treasurer, then the County files a lawsuit. Through order of the Fauquier County Circuit Court, Fauquier County seeks appointment of a Special Commissioner of Sale and that person sells the real estate to pay the past due taxes. There are no tax sales of personal property: vehicles, farm equipment, etc. Tax sales are held periodically without any regularity. Scheduled, will be listed below.
