NOTICE: Judicial Sale of Real Property

On April 6, 2026, or as soon thereafter as is practicable, Tanya Remson Wilcox, the Fauquier County Treasurer, under the authority of § 58.1-3965 et seq. of the Code of Virginia will commence proceedings in the Circuit Court of Fauquier County to sell the following parcels of land for payment of delinquent real estate taxes:

  1. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in Cedar Run Magisterial District, Fauquier County, Virginia, containing 2.5 acres, more or less, as the same is shown on that certain Plat of Survey of James G. Butler, Jr., dated April 16th, 1973 , and recorded with and made a part of that certain Deed dated April 24th, 1973, and recorded April 25th, 1973, in Deed Book 289, at page 144, among the land records of the Circuit Court of Fauquier County, Virginia. TOGETHER WITH a 50’ right of way to Route 612 as shown on the aforesaid Plat of Survey. AND BEING the same property conveyed to Connie Shellington and Beatrice Shellington by virtue of that certain Deed from James Herman Webster and Perline Webster dated April 24th, 1973, and recorded April 25th, 1973, in Deed Book 289, at page 144, among the land records aforesaid. Connie Shellington died November 12, 1977, survived by his wife Beatrice Shellington, making her the surviving tenant. Beatrice Shellington died intestate January 11, 2004, survived by a son, James H. Shellington, and a daughter, Eunice Shellington, who died October 10, 2016, said to be survived by two children, Devon Hamlet and Sierra Hamlet. Said parcel is known as 7849-57-5204-000. The physical address of the property is 1573 Sheldon Lane in Catlett, VA. The current owners of record are James Shellington and The Heirs of Eunice Shellington.
  2. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in Fauquier County, Virginia, containing 74.20 acres, more or less, as the same is shown on that certain Plat of Survey of William D. Barker, L.S., dated February 11th, 2008, and recorded February 12th, 2008, in Deed Book 1287, at page 1875, among the land records of the Circuit Court of Fauquier County, Virginia. AND BEING a portion of the property conveyed to New Day Farms, LLC, by virtue of that certain Deed from Wolfgang Boeker and Carla Jean Carmona-Boeker dated August 20th, 2007, and recorded August 21st, 2007, in Deed Book 1273, at page 1269, among the land records aforesaid. Said parcel is known as 6897-83-1124-000. The physical address for the property is 5626 Savannah Branch Rd., Bealeton, VA. The current owner of record is New Day Farms, LLC.
  3. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in the Town of Warrenton, Fauquier County, Virginia, containing ½ acre, more or less, and being more particularly described by metes and bounds as follows, to wit: BEGINNING at (A) a post in Jeffries line corner to Lucy Fairfax’s purchase of the said Bettie A. Oliver; thence with said purchase S 63 E passing Lucy Fairfax’s corner at 22.92 pos (*note, handwritten “in all 24 Pos” inserted here) to (B) a stake thence N 50 ½ E 3.56 pos (C) a stake corner to Lot No. 2; thence with No. 2, N 63 W 24 pos to (D) a stake in Jeffries line corner to No. 2; thence S 50 ½ W 3.56 pos to the beginning. AND BEING the same property conveyed to Oliver Fairfax by virtue of that certain Deed George H. Fairfax and Anna E. Fairfax dated October 28, 1921, and recorded in Deed Book 122, at page 421, among the land records of the Circuit Court of Fauquier County, Virginia. Said parcel is known for tax purposes as 6984-70-0932-000. The physical address of the property is 105 Old Mill Lane, Warrenton, VA. The current owners of record are the Heirs of Oliver Fairfax.
  4. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in Lee Magisterial District, Fauquier County, Virginia, fronting on the south side of State Route 745, being designated as LOT 2, as the same is shown on that certain Plat of Survey of John Boldridge, C.L.S., dated February 22nd, 1964, and recorded in Deed Book 224, at page 588, among the land records of the Circuit Court of Fauquier County, Virginia. LESS AND EXCEPT THEREFROM that certain portion conveyed to the Commonwealth of Virginia in Deed Book 635, at page 69, among the land records aforesaid. AND BEING a portion of the property conveyed to Calvin Mullins and Diane Margaret Mullins by virtue of that certain Deed from Cecil T. Henderson and Kathryn V. Henderson dated March 28th, 1978, and recorded in Deed Book 359, at page 627, among the land records aforesaid. Calvin Ernest Mullins departed this life July 16th, 1999, leaving Diane M. Mullins as sole surviving tenant. Diane M. Mullins departed this life on April 30th, 2009, and by virtue of her Last Will and Testament recorded in Will Book 244, at page 1271, devised the property aforesaid in equal portions to her children Colene Mullins and Ernest Mullins. Ernest Mullins departed this life on December 18th, 2015, intestate, leaving Sylvia Buyna-Mullins as his sole heir at law. Sylvia Buyna-Mullins departed this life on February 28th, 2016, intestate, leaving Laura Buyna as her sole surviving heir. Colene Mullins departed this life on November 7th, 2019, and by virtue of her Last Will and Testament recorded in Will Book 278, at page 2005, devised her interest in the property aforesaid to The Trustee of The Colene Mullins Living Trust. Said parcel is known as 6990-12-8401-000. The physical address of the property is 6343 Liberty Road, Bealeton, VA. The current owners of record are The Trustee of The Colene Mullins Living Trust and Laura Buyna.
  5. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in Lee Magisterial District, Fauquier County, Virginia, fronting on the south side of State Route 745, being designated as LOT 3, as the same is shown on that certain Plat of Survey of John Boldridge, C.L.S., dated February 22nd, 1964, and recorded in Deed Book 224, at page 588, among the land records of the Circuit Court of Fauquier County, Virginia. Green, Jr.; on the West by land now or formerly owned by W. C. Stribling; and on the North by the railroad, being situated directly across State Route #757 and the railroad, from a tract containing 18 acres now or formerly belonging to Henry C. Green, et ux. AND BEING the same property conveyed to Rail Associates, Trustee for Railside Trust; by virtue of that certain Deed from The Bank of New York, as Trustee for the Benefit of CWABS, Inc., Asset-Backed Certificates, Series 2007-13; dated December 18th, 2008, and recorded in Deed Book 1308, at page 45, among the land records aforesaid.Said parcel is known for tax purposes as 6021-52-5938-000. ALL THAT certain lot or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being situate in Lee Magisterial District, Fauquier County, Virginia, on the southwesterly side of Virginia Route 805 about one (1) mile east of Bealeton, containing 14 acres, 1 rood, 30 poles, more or less; and more particularly described by metes and bounds as follows, to wit: BEGINNING at an old broken down willow oak on west side of run and corner to Fant; thence S 32°30’00” E 58.4 poles to corner 2, an elm; and in line of W.O. Miller; thence S 49°45’00” W 59.6 poles to corner three a stone; thence N 12°45’00” W 36.8 poles to corner four, a stake on west side of run; thence N 22°45’00” E 56.5 poles to the point of beginning. TOGETHER WITH a right of way twelve (12’) feet wide and beginning at a corner one and following the run to the main road. AND BEING the same property conveyed to Melvin Douglas Baldwin, Sr., by virtue of that certain Deed from David B. Jenkins and June E. Jenkins dated April 4th, 1984, and recorded in Deed Book 464, at page 444, among the land records of the Circuit Court of Fauquier County, Virginia. Said parcel is known as 6899-93-4639-000. It has no physical address. The current owners of record are The Heirs at Law of Melvin Douglas Baldwin, Sr.

Property owners may request of the Treasurer a payment agreement to permit the payment of all delinquent amounts over a period that is reasonable under the circumstances but in no event that exceeds 72 months in accordance with Code of Virginia § 58.1-3965. Any such agreement shall require payment of current tax obligations timely and in full. Foster, C.L.S., dated January 15th, 1995, and recorded in Deed Book 736, at pages 1453 & 1454, among the land records of the Circuit Court of Fauquier County, Virginia. Butler, Jr., C.L.S., dated January 21st, 1974, and recorded in Deed Book 300, at page 186, among the land records of the Circuit Court of Fauquier County, Virginia. AND BEING the same property conveyed to Louis I. Klepitch Jr. by virtue of that certain Deed from Anthony J. The Code of Virginia § 58.1-3965 authorizes the Treasurer to initiate the sale of real estate which is delinquent for more than 2 years as of December 31st.  The Treasurer reviews properties with delinquent taxes periodically to determine which properties will be sold.  After owners are notified, a legal notice is published in the local newspaper as well as on this site.

If the taxes aren't paid or a payment arrangement reached with the Treasurer, then the County files a lawsuit.  Through order of the Fauquier County Circuit Court, Fauquier County seeks appointment of a Special Commissioner of Sale and that person sells the real estate to pay the past due taxes.  There are no tax sales of personal property: vehicles, farm equipment, etc. Tax sales are held periodically without any regularity.
