TREASURER’S TAX SALE

One property available for purchase:

Pursuant to a decree of sale entered by the Fauquier County Circuit Court in case number CL25-30, the undersigned offers for sale pursuant to VA Code § 58.1-3965, et seq. by private offer until Wednesday, January 7, 2026 at noon the following property located in Fauquier County, Virginia, to satisfy delinquent taxes owed thereon:

1 acre +/- landlocked parcel, lying and being situate previously in Center Magisterial District, now in Marshall Magisterial District, on Lee’s Ridge near Warrenton, and owned by the Heirs of Nat Washington (PIN 6974-80-7911/PID19780). Appraised value: $6,800.00

Public auction will be held if a private offer of at least 100% of appraised value is not received by January 7, 2026 at noon. Appraised value is $6,800.00. The public auction will be held at noon on Friday, January 9, 2026 @ Fauquier County Circuit Court located at 40 Culpeper Street in Warrenton, VA.

Sale terms: All funds must be paid by cashier’s check. Cash will not be accepted. The sale requires Court approval. A deposit of $1,000.00 or 10% of the purchase price, whichever is greater, must accompany all private offers and highest bids. Offers and highest bids submitted without deposits via cashier’s check will be rejected. Checks shall be made payable to “Clerk, Fauquier County Circuit Court” and be delivered to Special Commissioner with a completed offer of purchase form. Sale proceeds balances are due within 30 days of Court approval. The property is offered for sale as-is with all faults, without any warranties, express or implied, is conveyed by deed with special warranty of title, and is sold free of all liens. Special Commissioner of Sale makes no representations or guarantees as to the accuracy of the acreage or fitness for any particular use. As the property is landlocked, Special Commissioner cannot grant access or permission for interested parties to visit or inspect. Purchaser bears costs of title search, recording costs, and grantor’s tax.

The Code of Virginia § 58.1-3965 authorizes the Treasurer to initiate the sale of real estate which is delinquent for more than 2 years as of December 31st.  The Treasurer reviews properties with delinquent taxes periodically to determine which properties will be sold.  After owners are notified, a legal notice is published in the local newspaper as well as on this site.

If the taxes aren't paid or a payment arrangement reached with the Treasurer, then the County files a lawsuit.  Through order of the Fauquier County Circuit Court, Fauquier County seeks appointment of a Special Commissioner of Sale and that person sells the real estate to pay the past due taxes.  There are no tax sales of personal property: vehicles, farm equipment, etc. Tax sales are held periodically without any regularity.
